PROBLEM TO BE SOLVED: To provide a treatment propriety determination device capable of determining whether a driver is in a treatment possible state without allowing a driver to perform a driving operation having a possibility to restart a vehicle in a restart impossible state.SOLUTION: A treatment propriety determination device 100 is the device to be used in a vehicle for automatic driving, so as to determine whether a driver of a vehicle is in a treatment possible state. The device includes: a restart impossible state determination section 110 for determining whether a vehicle becomes in a restart impossible state; a stepping-down request section 111 for requesting stepping-down of a brake to a driver on the basis of a fact that the restart impossible state determination section determines a restart impossible state; a tread force acquisition section 112 for acquiring tread force of a driver with respect to a brake; and a treatment propriety determination section 113 for determining that a driver is in a treatment possible state when the stepping-down request section requests the stepping-down of a brake and tread force to be acquired by the tread force acquisition section becomes in a stepping-down state in a stepping-down reception period based on a time when the stepping-down request section requests the stepping-down of a brake.SELECTED DRAWING: Figure 1
