This chapter presents some of the medico‐legal issues that arise in the practice of medicine in a travel setting, including the legal framework of medical malpractice, the nuances that arise in malpractice cases in travel settings, duty to rescue, the Good Samaritan law and the liability of trip operators. A review of the steps that operators and physicians can take, prior to travel, to reduce legal and financial liability in malpractice settings is presented. The chapter concludes with a discussion of additional practical considerations regarding medico‐legal issues in a travel setting.
