The invention relates to a vehicle path generation apparatus and a method thereof. The vehicle path generation apparatus includes: a processor; and a storage device configured to store data and an algorithm, when the data and the algorithm are executed by the processor, cause the processor to: in response to a cut-in activation condition being satisfied during autonomous driving of the vehicle, set a drivable area for cut-in to generate a cut-in path within the drivable area, and control the vehicle to follow the cut-in path, when there is no space available for performing a lane change for a cut-in, the processor is configured to determine that a cut-in activation condition is satisfied.
