The National Transportation Safety Board determines that the probable cause of the near capsizing of the MERRY JANE was the failure of the operator to keep his vessel near the center of the passage between Bodega Head and Bodega Rock and to avoid a course through the shallower water near Bodega Rock where there was potential for incoming swells to increase in height and to break and to strike his vessel at a greater quartering angle. Contributing to the loss of life was the fact that only one of the passengers was wearing a life preserver when they entered the water.
